By using the Ka'ū Living Network app ("App"), you agree to the following terms, conditions, and disclaimers below. These terms are designed to clarify risks, define responsibilities, and limit legal liability to the maximum extent permitted by applicable law (including Hawaii law).
1. Platform Role and Independent Parties
Ka'ū Living Network is a technology platform that connects individuals for rideshare coordination, service listings, gigs, job posts, events, pet support, bulletin board activity, and community projects. The App does not:
- Provide transportation, employment, or any service itself
- Act as an agent, employer, dispatcher, broker, or contractor for users
- Screen or certify the qualifications, backgrounds, licenses, or insurance of drivers, service providers, or other users
All drivers, service providers, event organizers, and posters are independent parties, and all arrangements occur directly between users.
2. Use at Your Own Risk
Any ride, service, gig, or arrangement initiated through the App is made entirely at your own risk. Ka'ū Living Network does not guarantee safety, reliability, or quality of any posted service, transportation, assistance, or user profile. You are responsible for your own choices and actions. This includes verifying driver credentials, insurance, service qualifications, and job legitimacy.
3. Insurance, Licensing, and Legal Compliance
Drivers must ensure they have appropriate vehicle registration, insurance, and legal permission to transport passengers under applicable laws, including but not limited to requirements set by the State of Hawaii or county authorities. The App makes no representation that any driver is licensed or insured for passenger transport or commercial service.
Service providers are responsible for compliance with all applicable professional licensing, safety, and business regulations.
4. Communication and Contact Info
Users may choose to share contact information (phone, email) or use in-app messaging. Ka'ū Living Network does not verify or endorse any contact details. You agree not to hold the platform responsible for:
- Miscommunication
- Fraudulent or inaccurate contact info
- Loss arising from external communication
5. No Warranty
ALL CONTENT, LISTINGS, AND SERVICES AVAILABLE THROUGH THE APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, Ka'ū Living Network DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.
6. Limitation of Liability
In no event shall Ka'ū Living Network, its owners, officers, employees, agents, or affiliates be liable for any:
- INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES
- LOSS OF PROFITS, DATA, OR GOODWILL
- CLAIMS ARISING FROM ANY POSTED RIDE, SERVICE, OR USER INTERACTION
Even if advised of the possibility of such damages. If any part of this limitation is found invalid, the maximum liability will be limited to the amount paid for services (if any) in the last 12 months.
7. User Indemnity
You agree to indemnify, defend, and hold harmless Ka'ū Living Network and its personnel from and against any claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of the App
- Any content you post
- Your violation of these terms
- Any third-party claims related to your conduct
8. Privacy and Data Use
The App collects personal information such as email, contact info, usage data, and local preference data to provide services and analytics. We do not sell personal data. Users consent to data collection, storage, and processing as described in the Privacy Policy, including anonymized analytics and behavioral retention metrics.
Location data is used to improve community matching and listing visibility, never shared without consent.
9. Governing Law
These terms and any disputes are governed exclusively by the laws of the State of Hawaii, without regard to conflict of law principles. Any legal action shall be heard in the state or federal courts in Hawaii.
10. DAO Fund Participation
Contributions to the DAO treasury are voluntary. Participating in DAO governance does not confer ownership rights, financial returns, dividends, or guarantees of project success. DAO voting is managed via smart contracts and applies only to collective decision-making as outlined in the DAO governance documentation (linked separately in the app or on the website).
